Operational Policy

1 General Principles

1.1 Purpose

This Operational Policy (the “Policy") complements the STEPIN End User License Agreement (“EULA”), Privacy Policy, Virtual Goods Policy, Community Guidelines of STEPIN (“Platform” or “App”) established by Sidewalk Entertainment Inc. (“Company”, “We” or “Us”). The aim of this Policy is to provide convenience and protection to our users. It sets out rules of conduct, guidelines for service restrictions, and additional policies related to the use of STEPIN.
All users must comply with all the provisions of this Policy. If You violate provision of the Policy, You will also be considered to have violated EULA and may be subject to use restrictions under the rules set forth by this Policy and EULA.
Matters that are not covered by this Policy shall be interpreted and treated in accordance with EULA, Virtual Goods Policy, Privacy Policy and Community Guidelines. By accessing and using STEPIN, you acknowledge and accept all Terms and Conditions of STEPIN.
Any matters which are not mentioned in this Policy will be interpreted and determined following EULA, Virtual Goods Policy, Privacy Policy, Community Guidelines and other relevant laws and regulations of the Republic of Korea.

1.2 Changes to this Policy

In order to constantly improve the quality of our service, the Company may revise and edit this Policy and in general circumstances, we will notify you of such changes through in-app announcements, email or other channels.
To avoid any losses or inconvenience, please review the Policy and familiarize with the altered information. The Company will not be liable for any losses, damages or inconveniences incurred due to users’ lack of awareness.

2 User’s Responsibilities and Rights

1.
You are entitled to access and use a variety of features, content and services provided by the Platform.
2.
You are obligated to understand and follow all Terms and Conditions set forth by this Policy. The Company will not be able to assist you with any damages or issues arising from your failure to follow the Policy.
3.
You must report to the Company of any issues (e.g., system errors or bugs) you encounter during your use of the Platform. If you fail to notify us of relevant issues, exploit them to your advantage, or cause harm to other users, your use of the Platform may be restricted in accordance with this Policy and EULA.
4.
If it is discovered you have provided false or someone else's information in the account registration process, you may be restricted from using the Platform and will not be able to claim any rights to your account.
5.
You may be restricted from using the Platform if you spread false information that the Company has not officially announced and cause confusion to other users.
6.
If you are restricted from using the Platform due to your violation of this Policy, the Company will not be responsible for any damages, losses or inconveniences.
7.
You must utilize applicable security services to maintain the safety of your account and you must not share, transfer, or sell your personal and account information to others. Please note the Company is not responsible for any losses or damages incurred as a result of users’ negligence.
8.
In the STEPIN community, users are to respect each other’s rights, content, preferences and speech etc.
9.
Users has the responsibility to acquaint the entire Policy. The Company will not be liable for any loss, damages or disruptions caused by users’ failure to comply with it.

3 Operator’s Role and Duties

The Operator has the duty to ensure a safe, comfortable and harmonized Platform environment for all users, and acts in compliance with the rules and guidelines set forth in this Policy.
The Operator shall not intervene in or be involved in activities and disputes between and/or among users. However, the Operator may impose service restrictions or other measures in situations where a dispute between and/or among users is determined to be influential to the Platform, such as the following:
(1) Use of unauthorized program or interference of others’ use of the Platform which adversely affects the Platform’s normal operations;
(2) Disputes between individuals but affecting an unspecified number of users;
(3) Dispute between users which obscures the rules or order of the App, or violates the law.
The Operator is prohibited from offering benefits or privileges to specific users and from providing news about the Platform’s future updates, services and events that are not publicly announced.
The Operator shall not request, modify, or disclose any user’s personal information within the Platform. However, in case personal information of users are requested legitimately by a government agency or law enforcement agency.
The Operator constantly works to identify and fix issues or bugs in the App, and respond to service-related issues reported by users.
If any abnormal situations such as bugs or errors arise within the Platform, the Operator may remove or suspend the related content, services or functions etc.
If there are disruptions that impact the Platform’s operation or users’ use of the Platform, the Operator will implement procedures based on the Company’s regulations and social norms, and protect the Platform environment and service for the users.

4 Recovery Policy

In the event that a user's virtual goods, content, or data are changed or lost due to a Platform update or error, we will assist in their recovery to the best of our ability, provided the loss or error is proven by in-app records and the recovery process does not disproportionately affect the Platform's function.
Items, virtual goods and content of users are subject to change, modification or deletion due to the Platform’s update, plans or operations. In such situations, the content will not be recovered.
In general circumstances, losses resulting from a user’s lack of awareness or understanding of the Platform system, Operational Policy, EULA, other policies or announcements related to the App, are not eligible for recovery.
Recovery is not eligible for losses caused by intentional or negligent acts of users.
If the loss is caused by the intentional or negligent acts of users, such as the following, the associated loss is irreparable.
1.
Unstable internet connection of device used to access or use the App;
2.
Losses arising from user’s failure to follow the terms and conditions of the App, the Policy, information or announcements related to the App;
3.
Losses caused by user’s negligence or willful misconduct (e.g., sharing of user account information, negligence, fraudulent activity, etc.).
Users may request recovery of a loss by emailing customer support at stepin.cs@sidewalkplay.com or through the in-app inquiry channel within 15 days of the loss. Requests for recovery made after 15 days of the loss will not be fulfilled.
We offer recovery support to lower inconvenience and increase user satisfaction. However, if users abuse our recovery support service to gain profit inappropriately, service restrictions may be imposed on and items or data may be removed from the user account.

5 Service Restriction Criteria

1.
To safeguard the users and the Platform operations, the Operator will promptly take necessary measures against any violations of this Policy, such as causing damage to the App or interfering with its operation. The service restriction measures will be imposed in accordance with the Policy and the Company’s standards and protocols.
2.
The service restrictions imposed may vary depending on the severity of the act and frequency of occurrence. These restrictions may differ from the Table of Restriction Criteria and will be determined based on the situation.
3.
If a user is found to be involved in an action that violates the Policy, even if they did not directly commit the violation, they may still be subject to the same restrictions as the user account that did commit the violation.
4.
If multiple violations of this Policy are confirmed to be conducted from the same device information (such as IP address), all users accounts accessed through that device information may be subject to service restrictions.
5.
The Operator has the authority to take legal actions against the user or any third parties responsible for a violation of the Policy if it significantly disrupts the Platform’s operation or environment.
6.
If a user whose account was previously sanctioned due to violation of this Policy registers a new user account, the new account may subject to the same service restrictions imposed on the previous account.
7.
If a user uses unauthorized program, generated virtual goods through methods that violate the policy and used them in illegal transactions, the Operator may impose restrictions on their user account, including service and transaction restrictions.

Using a user ID/nickname that is created with partial modification of the above-mentioned prohibited user IDs/nicknames;  11. Using a user ID/nickname that is unconventional or socially inappropriate names in functions that allow users to set their own names is also prohibited;  12. Creating and using a user ID/nickname that is socially unacceptable, discriminatory or offensive.

6.2 Fraudulent Transactions of Virtual Goods and User Account Information

If only a portion of the virtual goods acquired through payment fraud or identity theft can be retrieved, the category "Virtual Goods not 100% retrievable" will be applied.
If any transactions of virtual goods, user account information, paid items, or other actions are confirmed to be related to illegal activities such as payment fraud or identity theft, temporary service restrictions may be imposed on the user accounts associated with such transactions. Depending on the investigation results, measures such as retrieval or deletion of virtual goods and service restrictions may be applied.

6.3 System Abuse, Improper use of Platform

7 Dormant Account and Policy

To prevent unauthorized usage of user accounts and provide smooth service to all users, the Company has established the criteria and measures for dormancy transition, as outlined below:

User accounts with no login records for 12 months or more
The account will be converted into a dormant state if the account is not longed in within 30 days after notification.
The Company will notify users via email 30 days before the expected date of dormancy transition. If the user does not access or use the Platform within the designated period even after receiving prior notice, the account will be converted into a dormant state and the related personal information will be retained as dormant.
If users wish access/use an account in dormant state, they may reactivate it by logging into the App.

8 Protection Policy for Teenagers

We recognize that teenage users have the right to make decisions regarding their personal information, and we strive to protect it. We take measures to prevent harm and adverse effects to teenagers and their personal information and guarantee their rights to modify, correct or delete their personal information. In addition, we have a zero-tolerance policy towards actions or attempts which may endanger teenage users, such as exposure to harmful or sexual content.
Personal information includes various information that can be used to identify individuals. Teenage users are responsible for not exposing their personal information (such as name, phone number, address, social media information, photos, videos, school, residence, personal ID number or content etc.) to others;
Personal information of teenage users can be deleted or hidden upon request by themselves or their legal guardians;
Any attempts made to acquire personal information of teenage users of actions of similar behavior will be subject to service restrictions;
Any users associated to actions of acquiring and/or dissemination of teenager users’ personal information may be immediately restricted from the access of the Platform and additional sanctions such as permanent App restriction. The Company also has the right to report the situation to investigative agencies.
Any users displaying, promoting or suggesting content which is sexual, unethical, or derogatory towards teenagers may subject to App restrictions;
Users meeting or attempting to meet a teenager in reality for sexual purpose with the use of the Platform will be immediately banned from the Platform and additional measures may be applied by investigative agencies;
Users providing, mentioning or implying sexual-related content which may cause teenage users to feel ashamed or embarrassed may face immediate service restrictions and additional measures may be applied by investigative agencies;
If the act of directly providing sexual content to teenagers or mentioning or implying sexual-related content that makes teenage users feel sexual shame is confirmed, platform access may be restricted immediately on the corresponding member account and other measures may be applied according to investigative agencies.
The Juvenile Protection Act of the Republic of Korea is applicable to teenager users.

9 Protection of Customer Support

Our customer support center strives to support all users to the best of our ability. Hence, users should respect our customer support representatives and acknowledge their efforts. Our Company has established related measures to protect and ensure the human rights of all representatives. If a user violates the human rights of a representative and disrupts the operation of the Platform, measures such as service restrictions on the related user account or termination of consultation may be applied.
The following situations are considered as violations of a customer support representative's human rights that disrupt the operation of our platform:
Acts of personal insult, profanity, sexual harassment, causing shame, and use of threatening expressions during the consultation process;
Acts of using profanity, making threats, engaging in sexual harassment, causing shame, and personal insults that are unrelated to our platform during the consultation process;
Using speech which may directly or indirectly cause serious mental harm during the consultation process.
